Upload Consent & Content License (DRAFT)

TEMPLATE, NOT LEGAL ADVICE. This is a starter draft. Fill in every [PLACEHOLDER] and have a licensed attorney review it before any Shop goes live. Whenever the checkbox wording changes, update CONSENT_TEXT and bump CONSENT_VERSION in upload-demo/app.py, so every upload stores the exact wording the Diner agreed to.

This document has three parts:

Part A: the short text that appears next to the required checkbox on the upload page.
Part B: the optional giveaway checkbox text.
Part C: the full Customer Content License that Part A links to.

You must be 13 or older to upload. If you're under 18, get a parent or guardian's OK first. We remove location data from your files. Don't upload anything you wouldn't want posted publicly.

Part B. Optional giveaway checkbox

Shown unchecked, separate from Part A. Uploading never requires entering the giveaway, and entering never requires a purchase.

Part C. Customer Content License

This License is an agreement between you (the person uploading, the "Uploader") and (1) the business named on the upload page (the "Shop") and (2) [COMPANY LEGAL NAME] d/b/a Crumbtrail ("Crumbtrail"), which runs the upload page and manages marketing for the Shop. You agree to it by checking the consent box and uploading.

"Content" means the photos, videos, and any caption or "what did you order?" text you submit through the upload page.

2. You keep ownership

You still own your Content. This License gives the Shop and Crumbtrail permission to use it. It doesn't transfer ownership.

3. The license you're granting

You give the Shop, and Crumbtrail acting on the Shop's behalf, a non-exclusive, royalty-free, worldwide license to:

post and repost your Content on the Shop's social media accounts (for example Instagram, Facebook, TikTok, Google Business Profile), its website, and in its emails, in-store screens, menus, and other marketing for the Shop;
edit it: crop, resize, trim, color-correct, add text, captions, stickers, music, or the Shop's logo, and combine it with other content (for example in a collage or reel), as long as the edits don't change its meaning in a misleading way; and
let the platforms and service providers that host, display, or schedule the posts make the copies they need to do that.

"Non-exclusive" means you can still share your Content anywhere else, including your own accounts. "Royalty-free" means you won't be paid for it. The giveaway is a separate, optional chance to win a prize.

This License continues until the Content is removed under Section 6.

Crumbtrail's own marketing: Crumbtrail won't use your Content to promote Crumbtrail itself (for example in its portfolio) unless you give separate permission. [OPTIONAL: add a separate, unchecked opt-in box if you want portfolio rights.]

4. Credit

If you provide a social media handle, the Shop and Crumbtrail will try to credit you by that handle when they post your Content (for example "📸 @yourname"). If you don't provide one, they may post the Content without credit, or with a general credit such as "one of our regulars." They won't publish your first name, email, or other contact details as a credit. A missing or wrong credit isn't a breach of this License, but tell us and we'll fix it where we can.

5. No obligation to post

The Shop decides what to post, and the Shop owner approves every post. Uploading doesn't guarantee your Content will be used, and the Shop or Crumbtrail may reject or delete any upload for any reason.

6. Removal on request

You can change your mind anytime. Email [email protected] (subject: "Remove my photo") with the Shop's name, roughly when you uploaded, and your handle or a description of the Content. You can also ask the Shop directly. Once we confirm the request:

we aim to remove the Content from the accounts we manage within 24 hours, and to ask the Shop to remove it from anywhere else it used it;
we'll stop any new use and delete the stored file (we keep the consent record as described in the Privacy Policy, to show permission was given); and
we'll email you to confirm.

Anyone clearly shown in your Content can also ask for removal. We'll honor that request too, without needing your OK.

What removal can't undo: copies other people have already shared, saved, or reposted; printed materials already produced (these won't be reprinted with your Content); and archival copies required by law.

7. Your promises

By uploading, you promise that:

You own the Content: you took it yourself, or you have the right to grant this License. It isn't copied from someone else.
Everyone clearly identifiable in it agreed to be included and to have it shared this way.
No minors without a guardian's consent. If anyone under 18 can be identified, their parent or guardian agreed. If you're under 18 yourself, your parent or guardian agreed to this License. You're at least 13.
The Content doesn't break any law or anyone's rights (copyright, trademark, privacy, or publicity), and it isn't obscene, hateful, harassing, violent, or misleading. It doesn't show anyone in a private or embarrassing situation without their consent, and it doesn't include copyrighted music or artwork you don't have rights to.
Any caption is your honest opinion. You weren't paid or given anything in exchange for a positive review or post. If you have a connection to the Shop (for example you work there, or you're a friend or family member of the owner), you'll mention it in your caption.

If any of this isn't true, don't upload. If you break these promises and someone makes a claim, you're responsible for it, to the extent the law allows.

8. Release

To the extent the law allows, you agree that you won't bring claims against the Shop or Crumbtrail for using your Content as this License allows, including claims about privacy, publicity, or likeness. This doesn't apply after you've asked for removal, to any use the License doesn't allow, or to claims that can't be waived by law.

9. Moderation and safety

We remove location metadata from files (see the Privacy Policy). The Shop and Crumbtrail review uploads before anything is posted and won't post content that clearly shows a minor's face unless a guardian's consent was indicated and the Shop approves. When in doubt, we crop to the food or don't post it.

10. Copyright complaints

If you think Content posted through this service infringes your copyright, email [email protected] with "Copyright notice" in the subject. Include: your contact information, the work you own, where the post appears, a statement that you have a good-faith belief the use isn't authorized, a statement that your notice is accurate, made under penalty of perjury, and your signature. [DMCA DESIGNATED AGENT NAME AND ADDRESS, if you register an agent with the U.S. Copyright Office.] We'll remove material that appears to infringe.

11. Privacy

How we handle your upload, handle, first name, email, and hashed IP address is explained in the Privacy Policy.

12. Other terms

This License is governed by the laws of the Commonwealth of Pennsylvania, except where the law of your state requires otherwise. If any part is unenforceable, the rest still applies. We may update this License for future uploads. Content you already uploaded stays under the version you agreed to, which we store with your upload.
